These Terms and Conditions (the “Terms”) govern your access to and use of the Make My Book website, mobile application, and related services (collectively, the “Service”). Make My Book (“we,” “us,” or “our”) provides an AI-powered platform that allows users to create personalized children’s books with custom stories and illustrations. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use the Service.
Please read these Terms carefully. They include important agreements about your rights and obligations, disclaimers of liability, and dispute resolution. If you have any questions, please contact us.
1. Eligibility
Adult Use: You must be at least 18 years old (or the age of majority in your jurisdiction) to register an account or make purchases on Make My Book. The Service is intended for use by adults (such as parents or guardians) who create books for children. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.
Use on Behalf of a Child: If you provide us with personal information about a child (e.g., name, photo), you affirm that you are the parent or legal guardian of that child or have the parent/guardian’s authorization to provide the information and to use the Service on the child’s behalf. You may not allow a child to use the Service without supervision.
We reserve the right to ask for proof of age or authorization at any time to ensure compliance. If we discover that we have collected personal information from someone under 18 without proper consent, we will delete that information (except as necessary to comply with laws or enforce our rights).
2. Account Registration and Security
Account Information: When creating an account, you agree to provide accurate, current, and complete information and to keep it updated (e.g., if you change your email address). You must choose a secure password and keep it confidential. Do not share your account login details with anyone else.
Responsibility: You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or any breach of security, you must notify us immediately. You can contact us at [email protected]. We are not liable for any loss or damage arising from your failure to adequately safeguard your account credentials or to inform us of unauthorized access.
One Account per User: You should create only one account for your personal use. Creating multiple accounts to circumvent limitations or to obtain additional free credits may result in account termination (see Section 11 on Termination).
Account Use: You agree to maintain the information in your account (including contact info) so that it is always valid and reachable. We may send you service-related communications via the contact info you provide (primarily via email). Ensure you have access to the registered email address.
Profile Name and Sharing: In some cases, you may be able to set a username or profile name. Please choose a name that does not infringe any rights or offend others. We reserve the right to remove or request a change of any username that impersonates someone, violates a trademark, or is inappropriate.
3. Using the Service
Personal and Lawful Use: You may use our platform and content generation features only for personal, non-commercial purposes (for example, creating books as gifts or for your own family). Commercial use, such as reselling our services or mass-producing books for profit, is not permitted without our explicit permission. Additionally, you agree to use the Service only for lawful purposes and in accordance with these Terms.
User Content Input: When using the Service, you will input content such as the child's name, characteristics, and perhaps a personal photo. You are solely responsible for the content you provide. By inputting any data or content, you represent and warrant that: (a) you have all necessary rights and permissions to provide that content to us and for it to be used as intended (if you upload a photo, you have the right to do so, and it does not infringe anyone's rights); (b) the content is accurate to the best of your knowledge (especially information about your child); and (c) the content is not illegal, harmful, or violative of any laws or rights (see Unacceptable Content below).
AI-Generated Content: Our Service uses advanced artificial intelligence to generate stories and illustrations based on your inputs makemybook.app . You acknowledge that, while we strive for high-quality, child-appropriate results, the AI may occasionally produce content that is unexpected or that requires minor corrections. We include automated checks and filters to prevent inappropriate content makemybook.app , but we cannot guarantee that every single output is perfect or fits your personal preferences. By using the Service, you accept that small imperfections in generated content do not constitute a breach of these Terms. If you encounter any content you find offensive or clearly inappropriate, please contact us so we can address it (for instance, by offering an edit or credit).
Unacceptable Content and Conduct: You agree NOT to use the Service (including any content input or generated output) in ways that:
a. Violate Laws: Violate any applicable law or regulation, including privacy laws (for example, by uploading someone else’s sensitive personal information without consent), intellectual property laws (uploading copyrighted material without permission), or others.
b. Are Harmful or Exploitative: Include any content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You may not attempt to generate content that is pornographic, sexually explicit (particularly not any content involving minors), hateful, violent (beyond standard children's adventure context), or discriminatory. Our platform specifically focuses on child-friendly content; attempts to misuse it for adult or harmful content can lead to immediate account termination.
c. Infringe Rights: Infringe or violate the rights of any other person or entity, including intellectual property rights, privacy rights, or publicity rights. For example, do not upload a photo that you do not have permission to use, and do not request the AI to produce text or images replicating copyrighted characters or trademarks makemybook.app . (Note: Our system is designed to create original content and avoid famous characters to ensure uniqueness and avoid copyright issues.)
d. Impersonation: Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity. You should not use someone else’s name or identity in a misleading way when using the service (except that you might, for example, create a book where a fictional character name is used with proper rights).
e. Spam or Exploitation: Attempt to spam the service or its outputs (e.g., generating extremely large volumes of content in an automated fashion via unauthorized means) or exploit any part of the service (like using automated tools or scraping content from the site). You should also not attempt to reverse engineer our AI model or circumvent usage restrictions.
f. Interference: Interfere with or disrupt the Service or servers/networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service (for example, not attempt to bypass measures we take to restrict certain content or volume of generation).
Content Monitoring: While we do not manually review all content, we reserve the right (but have no obligation) to monitor and review any content you input or that is generated, to ensure compliance with these Terms and with our policies makemybook.app . We may remove or refuse to display any content (including AI outputs) that we reasonably believe violates these Terms or applicable law. This includes shutting down a generation session that appears to produce disallowed content or editing obvious errors in a generated text if discovered.
Customization Limits: The Service allows a wide range of personalization (names, characteristics, themes, etc.), but within certain limits to maintain quality and feasibility. For example, there may be character limits on inputs or limits on how many free pages you can generate with a trial credit. These limits are clearly indicated in the interface (see FAQ/guide on the site). By using the Service, you agree not to attempt to exceed or circumvent these limits (such as creating multiple accounts for extra free credits, which is addressed in “Eligibility”).
One Free Book Credit: We generally offer a one-time free credit (currently €4) per new user so you can create a short trial book makemybook.app makemybook.app . This is a goodwill offering and might be subject to change or discontinuation. Abusing this system (for example, by creating multiple fake accounts to get multiple free credits) is strictly prohibited and can lead to termination of all associated accounts.
Mobile App Use: If you use our mobile app, note that these same Terms apply. Additionally, usage of the app is subject to the rules of the app store (Apple App Store or Google Play) from which you downloaded it. Ensure your device meets the compatibility requirements. We are not liable for any issues arising from using outdated devices or jailbroken/rooted devices.
Multilingual Use: Our platform supports multiple languages for content generation makemybook.app . However, the Terms and official communications will generally be in English (unless otherwise specified). If you use the Service in another language, these Terms still apply. Some translations of our content or legal terms might be available for convenience, but the English version of legal terms governs in case of any conflict.
4. Pricing and Payments
Free Access and Credits: Registration is free. Upon sign-up, we currently provide a promotional credit (for example, €4) which typically is enough to create a short sample book (like a 4-page story) makemybook.app makemybook.app . After using your free credit, further use of certain features (like creating longer books, downloading high-resolution PDFs, or ordering prints) will require payment.
Pricing Structure: Our pricing is transparent - there are no hidden fees makemybook.app . Key points include:
Page Creation: Creating each page of story content costs €1 (one euro) makemybook.app . For example, a 10-page story costs €10 in generation credits (minus any free credit applied).
PDF Download Fee: Downloading the final book as a high-quality PDF file (with layout and illustrations) incurs a flat fee of €3 makemybook.app per book. This covers the file preparation and hosting for lifetime access makemybook.app .
Printed Book: Ordering a physical printed copy of the book involves an additional fee, currently ranging from €8 to €12 depending on options (hardcover vs. softcover) makemybook.app , plus shipping. The price will be clearly shown at checkout.
Shipping Costs: Shipping costs vary by destination and will be calculated during checkout makemybook.app . Any applicable shipping charges are displayed clearly.
Taxes: Our prices include VAT (value-added tax) where required by law. If you are purchasing from outside the EU, the price might not include local taxes or duties; however, typically for digital goods, there’s no additional duty. For physical products shipped internationally, you are responsible for any import duties or taxes (see Section 5). We will charge VAT for EU customers based on the country of purchase and will comply with all tax laws.
Changes to Pricing: Our prices and fees may change from time to time (for instance, we might run promotions or adjust fees). However, the price you agree to at the time of placing an order is the price you will pay (we won’t charge more after the fact). We will honor any free credit or discount that was active when you started the process of book creation for that book.
Payment Terms:
Payment Methods: We accept various payment methods, such as major credit/debit cards, PayPal, or other methods as indicated on our site or app. If you use the mobile app, in-app purchases may be billed through the app store platform (e.g., Apple or Google) according to their terms.
Authorization: By providing a payment method, you represent that you are authorized to use that method and you authorize us (and our designated payment processors) to charge the full amount due for your order (book generation credits, PDF fee, print fee, and any shipping) makemybook.app makemybook.app .
Timing: For digital content (like generation credits or PDF downloads), charges are typically processed immediately. For physical products, your payment will be processed when the order is placed (unless otherwise indicated).
Receipts: After payment, we will provide a confirmation or receipt via email or through the platform, detailing the charges. If you need an invoice with specific details (like VAT ID), please contact our support.
Third-Party Processors: Payments on our site are handled by third-party processing services (like Stripe). These services may have their own terms and privacy policies, which you should review. We do not store your full credit card number on our servers; that information is transmitted directly from you to the processor via secure encryption.
Currency: All prices are listed in Euros (€) unless stated otherwise. If you pay with a non-Euro credit card, your bank may charge currency conversion fees or use their own exchange rate. We are not responsible for any differences due to currency conversion or bank fees.
No Hidden Fees: We guarantee no hidden charges beyond what is clearly presented: e.g., number of pages * page price, plus PDF fee, plus any print/shipping options you select makemybook.app . If a feature or add-on has a cost, it will be shown before you incur the charge (for example, if in the future we offer an optional additional illustration for a fee, it would be clearly optional).
Promo Codes / Discounts: If we offer promotional codes or discounts, they are subject to any terms provided (e.g., one-time use, expiry date). Only one promo code can be used per order unless explicitly stated otherwise. Promo credits have no cash value and are not transferable.
Subscription Plans: (Note: As of the effective date, we operate on a pay-per-book model, not a subscription. If in the future we introduce subscription plans for a certain number of books per month or similar, those terms will be provided separately. Right now, you pay as you go, per book/project.)
Payment Issues:
If your payment method fails or an amount remains unpaid, we may suspend or cancel the transaction or your access to paid features. You agree to pay any amounts due.
We reserve the right to retry charging your payment method if the initial attempt fails (e.g., reattempt a few days later). We will notify you if a payment fails and give an opportunity to update payment details.
We are not responsible for fees that your bank or payment provider may charge (like overdraft fees, foreign transaction fees, etc.).
5. Orders, Shipping, and Delivery
Digital Products (PDF Downloads):
Availability: When you complete a book and purchase a PDF download, we will make the high-resolution PDF available to you via your account for download. Typically, this is immediate upon payment confirmation. You can find it under your account’s “Downloads” or “My Books” section. If you have issues downloading, please contact support.
Quality: The PDF is provided in a print-ready, high-quality format (suitable for home printing or digital viewing). We use industry-standard formats (like PDF in A4 or similar size) with high resolution images.
Lifetime Access: Once purchased, you will have ongoing access to your PDF file through our service makemybook.app . We currently plan to allow unlimited re-downloads for the foreseeable future makemybook.app . However, we encourage you to save your own copy after download. In the unlikely event we need to discontinue hosting, we will provide notice so you can download your files.
No Physical Shipment: No shipping applies for PDF purchases, since these are digital. You will not receive any physical item for a PDF-only order.
Physical Products (Printed Books):
Production: When you order a printed book, we will print a custom book based on the final content you approved. Our books are high-quality and professionally bound (hardcover or softcover as chosen) makemybook.app . Production time is usually short (often within 1-3 business days after order), but can vary depending on current order volumes and complexity (e.g., hardcover might take a bit longer). We strive to maintain high production standards, similar to books you'd find in a store makemybook.app .
Shipping Territory: We ship books to many countries worldwide makemybook.app . During the order, you’ll be able to select your country. If your country is not listed, it means we currently cannot ship there. We will update our shipping zones over time.
Delivery Time: Estimated delivery times will be provided at checkout (for example, 5-10 business days for standard shipping to many locations) makemybook.app . Note that these are estimates, not guarantees. Delivery may take longer due to factors beyond our control (carrier delays, customs clearance, remote location, etc.). We recommend ordering well in advance if you need a book by a certain date (e.g., for a birthday, order at least 2 weeks ahead, as we suggest in our FAQ) makemybook.app .
Shipping Options: Depending on your address, we may offer multiple shipping options (standard, express, etc.) with different costs. All options and costs will be shown during checkout. Choosing express (if available) will generally provide a faster delivery window at a higher cost.
Shipping Costs and Duties: The cost of shipping is displayed at checkout and varies by destination makemybook.app . For international shipments, any import duties or taxes are your responsibility. We do our best to indicate if any known customs fees may apply, but each country is different. We primarily ship from within the EU (for EU orders) and possibly from the US for US orders, which can reduce duties in those markets. If a customs fee or import VAT is required upon delivery, you will need to pay it to receive the package. We are not liable for these fees or any delays caused by customs.
Tracking: We provide tracking information for all physical book orders whenever the shipping method offers it makemybook.app . You will receive a tracking number by email or in your account once the book is shipped. It’s your responsibility to track the delivery and make arrangements to receive the package (e.g., be home or pick up from a facility if needed).
Delivery Issues: If your package is marked as delivered but you did not receive it, please contact the carrier first (sometimes they leave it with a neighbor or there’s a delay). Then contact us - we will do our best to assist. However, be aware that risk of loss passes to you upon handing over the package to the carrier (see below). We will help communicate with the carrier and if a package is truly lost, we may, at our discretion, send a replacement or refund.
Incorrect Address: Please ensure the shipping address is correct and complete. We (and our shipping partners) rely on the information you provide. We cannot guarantee delivery if the address is wrong or incomplete. If a package is returned due to a bad address or because it was unclaimed, we will contact you for an updated address and will require additional shipping payment for resending it. If we cannot resolve the delivery (e.g., you do not respond or provide a deliverable address), we may treat the order as canceled (refunding the book cost minus shipping costs incurred, if any).
Transfer of Risk: For physical items, once we hand the package over to the carrier, risk of loss or damage passes to you makemybook.app makemybook.app . This means if the book is damaged in transit or lost by the postal service, we will assist you, but the primary liability is with the carrier. We package books carefully to minimize damage risk. If your book arrives with damage, please let us know (see Section 6 for returns/refunds). We may ask for photos of the damage to evaluate and improve packaging.
Delivery Acceptance: Upon receiving your book, please inspect it. If you find any issues (misprints, damage), notify us promptly (ideally within 7 days of delivery).
No Reselling: The books you purchase are for personal use or gifting. You agree not to resell the printed books in a commercial manner without our explicit permission (this doesn’t restrict you from giving it as a gift, of course, but you shouldn’t, for example, bulk order books to sell in a store without a separate agreement with us).
Pre-Orders: (If we ever allow pre-ordering of a new book theme or feature, the terms will be provided. At present, all purchases are created and processed on demand, not pre-ordered.)
6. Cancellation, Return, and Refund Policy
Because our books are personalized, different policies apply than for generic goods. Please read carefully:
Cancellation Before Creation: You have control of the process up until you finalize an order. If you’re generating a book and haven’t paid/checked out yet, you can abandon the process with no charges (except any used free credit, which doesn’t cost you money). Once you place a paid order (for a PDF or print), that order is immediately processed. For downloadable PDFs, this means you get instant access (and we cannot “return” the delivered file). For prints, we start production quickly.
Digital Products (PDFs): The digital product is created specifically and customized for the customer according to their order. Therefore, cancellations, replacements, or refunds will only be granted in exceptional cases where it is not possible to fulfill the customer's expectations or when there is a material defect in the final product. The decision regarding the provision of a replacement or refund, including their scope, shall be at the sole and absolute discretion of Make My Book, without any obligation on its part.
Physical Products (Printed Books): Our printed books are custom-made specifically for you and printed on demand. Since each book is printed specifically for the customer, physical books cannot be cancelled or refunded once the order is placed, unless there are printing errors or quality issues. In such cases, the decision to provide a replacement or refund will be at the sole discretion of Make My Book.
Quality Guarantee: We guarantee that the physical product will match the content you approved and be of merchandiseable quality (pages printed, bound, etc.). If there’s any problem with the created book (digital or physical), please let us know - your satisfaction is our priority makemybook.app .
Defective or Damaged Books: If your printed book arrives with a manufacturing defect or is damaged, please contact us within 7 days of delivery makemybook.app . Provide a description and photos of the issue. Examples of defects: pages misprinted or cut off, binding coming loose, etc. We will review and, if we confirm a defect, we will offer a free replacement (reprint and ship a new copy at no cost) makemybook.app . If a replacement is not possible in a reasonable time, we may offer a refund of the purchase price. Minor issues that do not affect use (like slight color variances or subtle printing artifacts) are not considered defects, but even for those, we want you happy, so reach out and we’ll see what we can do makemybook.app .
Story Satisfaction: We endeavor to create a story and images you'll love. If you’re not satisfied with the story outcome (e.g., you think it’s not engaging or you were expecting something slightly different), we encourage you to try adjusting the inputs (changing some details or theme) for a better result - often that yields a story more to your liking. While we can’t guarantee every story will meet every subjective expectation, we do offer to work with you: If you’re truly unhappy with the story, reach out. We can provide a one-time courtesy re-generation or minor text edits to address your concern, free of charge, as long as it’s within reason. This is part of our satisfaction commitment makemybook.app .
Exchanges: Since each book is unique, we cannot offer exchanges (you can’t exchange one personalized book for a different one). Instead, we address issues through reprints or fixes.
Return of Physical Book: Do not send any book back to us without authorization. Given the nature of the product, in most cases we won’t require you to return a defective book (a photo will suffice). If we do request a return for inspection, we will provide you a shipping label at our cost.
Refund Process: If a refund is approved (due to a defective product we can’t replace, or an extreme satisfaction issue), it will be processed to the original payment method. Allow a reasonable time for your bank to post the credit (usually 5-10 business days). If you paid via app store, the refund might be through that store. We will inform you of the method.
Chargebacks: We prefer to solve issues directly. If you initiate a chargeback with your bank for a transaction, we will provide the necessary documentation to show the legitimate charge (if applicable). Please be aware that misuse of chargebacks (claiming fraud or non-delivery falsely) is a violation of these Terms. It may result in account termination. Of course, if you truly didn’t authorize a transaction or didn’t receive a product, you have the right to dispute it - we just ask you to contact us first in most cases, as we can usually resolve it faster.
EU Right of Withdrawal (for completeness): As noted, by its nature our service falls under exceptions to standard EU withdrawal rights - personalized goods (for prints) and immediate digital downloads (for PDFs). Thus, the 14-day withdrawal right does not apply. That said, if you are an EU consumer, we remind you that if something wasn’t personalized (e.g., if we offered gift cards or non-custom goods, which currently we do not), those would have standard rights. This is just general info; currently all our main products are custom.
Satisfaction Guarantee: In summary, we stand by our product. If you’re not satisfied, we’ll do our best to make it right, whether by tweaking the story, replacing a product, or if necessary, issuing a refund makemybook.app . Our goal is for every child (and parent) to have a magical experience. Your trust matters to us.
7. Intellectual Property and Ownership
Our Service Content: All materials and content on the Make My Book platform (excluding the personalized books you create) are owned by us or our licensors and are protected by intellectual property laws. This includes the website design, text, graphics, logos, illustrations (other than those generated uniquely for your book), software code, and any content created by our team. Make My Book and our associated logos are our trademarks. You agree not to use our trademarks or any confusingly similar marks in any way without our prior written consent. You also agree not to remove or obscure any copyright, trademark, or proprietary notices on the platform.
Your Created Book Content:
Ownership of Outputs: We want you to fully own the story and illustrations that our AI creates for your personalized book makemybook.app . The unique story text and images generated specifically for you are considered "work made for hire" or are otherwise assigned to you. To the extent any copyright or intellectual property rights would vest in us (or our AI’s output) for the content of your specific book, we hereby assign all such rights to you upon your completion of the book and payment. This means the story and images in the final book are yours to use as you please makemybook.app . You can print, share, or even publish them.
License to Use Platform Materials: Note that while you own the content of your particular book, you do not own our underlying software, AI models, templates, or generic assets that may have been used to create your book. We grant you a license to use those as incorporated in your book, but you cannot extract our AI model or reuse our template designs separately outside the book. Essentially, you own the output (the final story and pictures), but not the tools used to generate it.
Your Input Content: You retain ownership of any original content you provide to us (for example, a photo you upload or a specific written passage you input). Providing it to us does not transfer your rights. By inputting content, however, you grant us a license to use that content as needed to provide the Service (see next point).
Rights You Give Us (License): In order to operate the Service and create your book, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (e.g., crop or resize a photo), and (to the extent necessary) distribute the content you provide only for the purpose of providing the Service to you makemybook.app makemybook.app . For example, you allow us to upload your child's details to our AI services to generate the story, to store your text and images in our database, and to display them back to you. We do not claim any further rights in your content. This license ends when you delete the content or your account (except for archival backups as described in our Privacy Policy). If you share content publicly via our Service (for example, if we had a community showcase, etc.), you would also allow us to use it for that display, but currently our service is private by default.
Content Sharing in Media and Marketplaces: Make My Book may offer you proposals to share the content you have created on social media or marketing platforms (Marketplace) for promotional and marketing purposes. Any such sharing shall be conducted solely after receiving your explicit and specific consent in writing or through a verified digital means. Without receiving explicit consent as aforesaid, Make My Book shall not share, publish, or distribute the content you have created on social media, marketing platforms, or any other platform, while maintaining your intellectual property rights and privacy.
Use of Your Book for Marketing: We will not use your personal book content (story, child’s name, photos) in our marketing materials or in public examples without your explicit permission makemybook.app . We might ask you if we can share a preview of your book as an example on our site or social media - but that’s entirely up to you. If you say no, we won’t. If you say yes, we might ask you to sign a release form, but the general principle stands: Your book is your personal treasure; we won’t show it off to others unless you’re okay with it.
Feedback: If you provide suggestions, ideas, or feedback about our Service ("Feedback"), we may use it without restriction or compensation to you, and you hereby grant us a perpetual and irrevocable license to do so. For example, if you suggest a new feature and we implement it, we own that implementation.
Respecting Third-Party Rights:
No Infringing Inputs: You agree not to input or upload content to our Service that violates third-party rights. For instance, do not upload a photo that you do not have rights to (like a professional photo you don’t have permission to use, or a picture of a person who hasn’t consented) makemybook.app . Similarly, do not input text that is copyrighted by someone else (like copying a story from another author) or ask the AI to produce content that is clearly someone else’s proprietary property (like writing a story about Mickey Mouse, which is Disney’s IP - our system likely blocks famous characters anyway) makemybook.app .
Generated Content Uniqueness and IP: Our AI generates original content and images for your book. We have designed it to avoid plagiarism and to create unique results for each request. The output is intended to be unique and not copied from existing works makemybook.app . However, AI is trained on patterns of language and art - while unlikely, if you believe an output unintentionally resembles a third-party work (e.g., a sentence happens to match a line from a known book), please let us know. You have the rights to use the output as described above, but it’s prudent (especially if you plan to publish widely) to review it. As a safeguard, we include filters to avoid known characters and names makemybook.app .
No Guarantee of Public Domain: Unless explicitly stated, do not assume any content (text or images) provided by our Service is public domain or free of all restrictions if separated from our context. It’s meant for your personal use. If you plan to commercialize your book beyond personal use, you might want to attribute that it was co-created with an AI or ensure compliance with any local laws regarding AI-generated works. We assign rights to you as above, but laws vary on AI content; we give you our rights, but if law said "AI content has no copyright," then there's no copyright to assert (this is a gray area internationally). By these Terms, at minimum, we won't claim rights in it as we gave them to you.
Platform License to You:
Grant of License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Service (including our website and app, and the tools to generate content) for its intended purpose of creating personal books.
